1. Parties and subject
These Terms of Use ("Terms") govern the relationship between Bovisio, located at Köprülü-Veysipaşa Mahallesi 1626 Sokak No:6, Efeler / Aydın, Türkiye ("Bovisio", "we"), and the natural and legal persons who open an account on or use the Bovisio platforms ("User", "you").
The Terms apply to the Bovisio farm management, veterinarian and advisor web platforms, their mobile applications, the promotional website and all services provided through them (the "Service"). By creating an account or using the Service, you confirm that you have read, understood and accepted these Terms.
2. Definitions
- Account: a record opened on behalf of a farm, veterinary clinic or advisory firm that one or more users can access.
- Account administrator: the user who opened the account or who has been given administrator rights on it.
- Content: the animal, health, breeding, milk, feeding, stock, accounting and similar records that users enter into the Service, as well as uploaded documents and images.
- Package: a paid or free subscription that determines the features available on the farm platform and its animal and user limits.
- Link: an authorisation by which a farm allows a veterinarian or advisor to access its records.
3. Opening an account and account security
- To use the Service you must be at least 18 years old and have legal capacity. If you open an account on behalf of a legal entity, you confirm that you are authorised to bind that entity to these Terms.
- The information you provide when registering must be accurate, complete and up to date. Keeping your account information current is your responsibility.
- You are responsible for keeping your username and password confidential and for not sharing them with third parties. Actions taken through your account are deemed to be yours. If you suspect unauthorised use, change your password immediately and inform us.
- The account administrator decides which users are added to the account and which permissions they receive; the account holder is responsible for the actions of these users.
- Veterinarian and advisor accounts are opened upon application. Bovisio reserves the right to verify the professional information given in the application and to reject an application without stating a reason.
4. Scope of the Service
Bovisio is a software service for keeping and analysing herd and farm records and for authorised information sharing between farms, veterinarians and advisors. The content, features and interface of the Service may change as it is developed; changes that adversely affect core functions will be announced reasonably in advance.
Reports, alerts, ration suggestions, breeding values, forecasts and similar calculations in the Service are intended as decision support. They do not replace a veterinarian's professional judgement, examination or diagnosis. The final decision and responsibility for the farm rest with the user.
5. User obligations
You agree to use the Service in accordance with applicable law, these Terms and the principle of good faith. In particular, the following are prohibited:
- acting with another person's information, identity or authorisation, or trying to access accounts or records you are not authorised to access;
- attempting to impair the security, integrity or operation of the Service, uploading malicious software or creating excessive load;
- copying or imitating the Service through reverse engineering, automated data extraction or unauthorised integrations;
- entering or sharing unlawful or misleading content, or content that infringes the rights of third parties;
- entering records subject to regulation, such as prescriptions, vaccinations, treatments and withdrawal periods, untruthfully.
Obligations arising from legislation for prescribing, administering medicines, vaccination and animal movements (including notifications to official registration systems) rest with the user. Records in the Service do not replace notifications that must be made to official systems.
6. Ownership of content and data
The Content you enter into the Service belongs to you. Bovisio processes the Content only to provide, maintain, improve and secure the Service and to fulfil its legal obligations, for the term of the agreement and limited to these purposes. Bovisio does not sell or rent Content to third parties without your permission.
Anonymised and aggregated data that contain no personal data may be used to improve the Service and for sector analyses and benchmarking.
When you grant access to a veterinarian, advisor or employee, you agree that they may view the records you allow and enter records within their permissions. You can withdraw access at any time; withdrawal does not affect actions taken up to that date.
7. Relationship between farm, veterinarian and advisor
Bovisio is not a party to the professional service relationship between a farm and a veterinarian or advisor. The provider of veterinary or advisory services is responsible for their content, quality, fees and results. Invoices, contracts and price lists issued through the Service reflect the relationship between those parties; Bovisio cannot be held responsible for their content.
8. Packages, fees and payment
- The farm platform is offered in packages. Package features, limits and current prices are shown on the purchase screen and the pricing page. Unless announced otherwise, the veterinarian and advisor platforms are free of charge.
- Payments are collected through a licensed payment institution. Your card details are not seen or stored by Bovisio.
- If a package is not renewed when it expires, access to paid features may be limited; your Content is not deleted and is kept for the period stated in section 12.
- Price changes are announced before they take effect and do not apply to periods already paid for.
- The rights of users who are consumers under Turkish Consumer Protection Law No. 6502 and related regulations remain reserved.
9. Continuity of the Service and maintenance
Bovisio takes reasonable technical and organisational measures to keep the Service running without interruption or error, but does not guarantee uninterrupted operation. Planned maintenance is announced in advance where possible and carried out outside peak hours. Interruptions caused by force majeure, infrastructure providers or internet connectivity are beyond Bovisio's responsibility.
Integrations with smart collars, milk meters, RFID readers and similar devices or with third-party systems depend on the terms and technical specifications of the device or service concerned.
10. Intellectual property
The software, design, interface, data model, training content, trademarks and logos of the Service belong to Bovisio or its licensors. These Terms grant you a non-transferable, non-exclusive licence to use the Service for the term of the agreement and only for your own business activities. No other rights are transferred.
11. Limitation of liability
Except in cases of intent and gross negligence, Bovisio is not liable for indirect or consequential damages such as loss of profit, indirect damages resulting from data loss, loss of production or loss of animals. The user is responsible for the consequences of decisions made on the basis of calculations and suggestions in the Service.
In any event, Bovisio's total liability under these Terms is limited to the total fees paid by the user to Bovisio in the twelve months preceding the event that caused the damage. This limitation does not apply where the law does not permit liability to be limited.
12. Suspension, termination and return of data
- You can close your account at any time from the account settings or by notifying us in writing.
- In the event of a serious or repeated breach of these Terms, non-payment, or circumstances that threaten the security of the Service, Bovisio may suspend the account or terminate the agreement after prior notice, or immediately where delay would be harmful.
- After an account is closed, your Content is kept for thirty (30) days, during which you can request a copy of your data. At the end of this period the Content is deleted or anonymised, except for records that the law requires us to keep.
13. Personal data
Your personal data are processed as described in the Privacy Policy and Data Protection Notice, in accordance with Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where applicable, the EU General Data Protection Regulation ("GDPR"). 14. Changes to the Terms
Bovisio may update these Terms to reflect changes in legislation or in the Service. Material changes are announced by e-mail or in-app notification at least fifteen (15) days before they take effect, and your renewed consent is obtained where required. If you do not accept the changes, you may close your account.
15. Notices and evidence
Notices to you are sent to the e-mail address or telephone number registered in your account, or by in-app notification. The parties agree that, in disputes arising from these Terms, Bovisio's system, transaction and access records constitute conclusive evidence under Article 193 of the Turkish Code of Civil Procedure No. 6100; the right to present counter-evidence is reserved.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Aydın have jurisdiction over disputes. Consumers retain the right to apply to consumer arbitration committees and consumer courts within the monetary limits set by law. Consumers resident in the European Union retain the rights granted to them by the mandatory consumer protection rules of their country of residence.
17. Entry into force and contact
These Terms take effect when accepted electronically during registration and remain valid for as long as the account is open. If any provision is held invalid, the validity of the remaining provisions is not affected.
